These Terms & Conditions apply to the purchase, enrolment in and use of all Calm Kidz Program online courses, including the Emotion Explorer Club, associated course materials, downloadable resources and any physical resources supplied as part of your enrolment.

By purchasing or enrolling in a Calm Kidz Program online course, you acknowledge that you have read, understood and agree to these Terms & Conditions.

1. About These Terms

These Terms form an agreement between you and Calm Kidz Program.

In these Terms:

“Course” means any online program provided by Calm Kidz Program, including the Emotion Explorer Club.

“Course Materials” means videos, worksheets, workbooks, PDFs, activities, guides, printables, emails, visual resources, audio or video materials and other digital content provided as part of the Course.

“Welcome Kit” means any physical products or resources supplied as part of an enrolment, where applicable.

“You” or “your” means the person purchasing or accessing the Course and, where applicable, the parent or caregiver supervising a participating child.

“We”, “us” or “our” means Calm Kidz Program ABN 76 320 525 914.

2. Who the Course Is For

The Emotion Explorer Club is designed for children Age 5-12 years to participate with the involvement and support of a parent, caregiver or responsible adult.

Persons under 18 must not purchase the Course independently.
All payment information must be provided by an adult or with the permission of an adult.
Parents and caregivers remain responsible for supervising their child while participating in the Course and determining whether particular activities or resources are appropriate for their child's age, developmental level, individual needs and circumstances.

3. Enrolment and Course Access

Your enrolment is confirmed once payment, or the required initial payment under an approved payment plan, has been successfully processed and confirmation of enrolment has been provided.

Unless otherwise stated at the time of purchase, enrolment in the Emotion Explorer Club includes:

the structured 10-week online program;
child-focused educational videos;
parent-focused educational videos;
activities, missions and downloadable resources;
access to the applicable Course Materials;
any Welcome Kit specifically included with your selected enrolment option;
limited email support as described in these Terms; and
6 months' access to the online Course from the date of enrolment.

Although the Emotion Explorer Club is designed to be completed over approximately 10 weeks, the six-month access period allows families additional time to revisit lessons, repeat activities and return to resources.

Course access automatically expires at the end of the applicable access period  

Extensions or re-enrolment may be available at our discretion and may incur an additional fee.

4. Fees and Payment

All Course fees are stated in Australian dollars (AUD) and include GST where applicable, unless otherwise stated.

Fees and payment options will be displayed at the time of enrolment.

We may change the price of future enrolments at any time. Any price change will not alter the agreed price of an enrolment already purchased.

5. Full Payment

Where you select the full-payment option, the total Course fee must be paid at the time of enrolment.

Course access will commence once payment has been successfully processed.
The first weekly lesson will be available immediately, from there, 1 weekly session will be unlocked every 7 days. 

6. Payment Plans

Where a payment plan is offered, the payment amount, number of instalments and payment schedule will be displayed before you complete your enrolment.

By selecting a payment plan, you agree to pay the full Course fee through the scheduled instalments.

A payment plan is not a weekly or monthly subscription that can simply be cancelled when you no longer wish to participate.

By selecting a payment plan, you authorise our third-party payment processor, such as Stripe where applicable, to automatically charge your nominated payment method for each scheduled instalment.

You are responsible for ensuring your nominated payment method remains valid and has sufficient funds available for scheduled payments.

Choosing to stop participating in the Course does not automatically cancel your remaining payment obligations, except where required by law.

7. Failed or Declined Payments

If a scheduled payment is declined, unsuccessful or becomes overdue, your access to the Course may be temporarily suspended or blocked until the outstanding payment has been successfully processed.

Suspension of Course access does not cancel any outstanding payment obligations under your agreed payment plan.

Once the outstanding payment has been successfully processed, Course access may be reinstated, provided your enrolment has not otherwise been terminated.

If you are experiencing genuine payment difficulties, please contact us as soon as possible.

8. Refunds and Change of Mind

Because the Emotion Explorer Club provides access to digital Course Materials and resources following enrolment, refunds are not provided for any reason.

This includes circumstances where you:

decide not to continue with the Course;
do not complete the Course;
do not access some or all of the Course Materials;
decide the Course is no longer suitable for your family;
experience a change in personal circumstances; or
discontinue participation while using a payment plan.

Where a payment plan has been selected, discontinuing participation does not automatically cancel the remaining instalments.

However, nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.

9. Email Support

Emotion Explorer Club participants may contact Anja by email during the active 10-week program period for occasional, brief questions relating to Course content or the general implementation of Course strategies.

For example, you might have a quick question about an activity, how to explain a Course concept to your child, or how to use one of the Course resources.

Email support is intended to provide general guidance and clarification while completing the Course.

Email support does NOT include:
daily or unlimited ongoing consultation;
immediate responses;
crisis support;
individual counselling or therapy;
detailed assessment of your child's circumstances;
diagnosis;
extensive review of your child's behaviour, school circumstances or family situation;
personalised treatment planning;
ongoing case management;
detailed personalised recommendations; or
communication with schools, health professionals or other third parties on your behalf.

Email is not monitored continuously or daily, and no same-day or specific response time is guaranteed.

Responses will be provided when reasonably practicable within normal business operations.

Email support is subject to reasonable use.

10. Personalised Support and Plans

The Emotion Explorer Club is designed as a general psychoeducational Course and does not automatically include individualised assessment or treatment planning.

If you would like Anja to review your child's individual needs, behaviours, circumstances or challenges and provide personalised recommendations or a tailored plan, you will need to purchase the relevant personalised service separately, where available.

Any personalised service will be subject to its own scope, fees and conditions.

Participation in the online Course itself does not constitute individual counselling or therapy for your child.

11. Educational Program — Not Individual Therapy

The Emotion Explorer Club is a psychoeducational program.

It provides general education, activities and strategies relating to children's:

emotions;
behaviour;
brain development;
nervous system and regulation;
emotional awareness;
coping skills;
executive functioning;
anxiety and bravery;
social and emotional learning; and
parent-child connection and co-regulation.

Although the Course draws upon professional counselling experience and evidence-informed concepts, participation in the Course does not constitute individual psychological, medical, counselling or allied-health assessment, diagnosis or treatment.

Information and strategies provided throughout the Course are general in nature and may not be appropriate for every child or family.

No particular therapeutic, behavioural, educational or developmental outcome is guaranteed.

If you have concerns about your child's mental health, physical health, development, behaviour, safety or wellbeing, you should seek advice from an appropriately qualified health professional.

12. Parent and Caregiver Responsibility

Parents and caregivers remain responsible for deciding how and when Course strategies are used with their child.

You know your child and their individual circumstances.

You should modify, pause or stop an activity if you believe it is inappropriate for your child or if your child becomes significantly distressed.

Course materials should not be used as a substitute for professional assessment or intervention where these are required.

13. Welcome Kit and Physical Resources

Where your enrolment includes an Emotion Explorer Welcome Kit or other physical resources, these will be sent to the delivery address provided during enrolment.

You are responsible for ensuring your delivery information is accurate and complete.

We are not responsible for delays or failed delivery resulting from incorrect or incomplete information provided by you.

Welcome Kit contents may occasionally vary due to product availability. Where reasonably necessary, we may substitute an unavailable item with another item of a similar purpose or value.

Some Course resources and Welcome Kit items may contain small parts or materials requiring adult supervision.

Parents and caregivers are responsible for ensuring physical resources are used safely and appropriately for their child's age and developmental level.

14. Health and Wellbeing Information

Any health, wellbeing, nutrition, lifestyle or supplement information mentioned within the Course is provided for general educational purposes only.

It is not:

medical advice;
a diagnosis;
a prescription;
an individual healthcare plan; or
a substitute for consultation with an appropriately qualified healthcare professional.

Before starting, changing or discontinuing medication, supplements, treatment or other health interventions, you should seek advice from an appropriately qualified professional such as your GP, paediatrician, pharmacist or other relevant healthcare practitioner.

Any decisions regarding medical treatment or health interventions remain the responsibility of you and your healthcare provider.

15. Emergency and Crisis Support

The Emotion Explorer Club and associated email support are not crisis or emergency services.

Email should not be used to seek urgent assistance relating to immediate risk, safety concerns, serious mental-health concerns or medical emergencies.

If you or your child requires urgent assistance, you should seek appropriate emergency or professional support.

16. Personal Use of Course Materials

Your enrolment provides you with a limited, non-exclusive, non-transferable licence to access and use the Course and Course Materials for your own family's personal, non-commercial use during your access period.

You may print downloadable materials where they are provided for personal family use.

Unless we have given prior written permission, you must not:

share your Course login with another person or family;
provide another family with access to your Course;
reproduce Course Materials for use with other children or families;
upload Course Materials to social media, websites, shared drives or other platforms;
distribute Course Materials to schools, teachers, counsellors, psychologists, allied-health professionals or other organisations;
sell or resell Course Materials;
copy, reproduce, adapt, edit or modify Course Materials for commercial or professional use;
use Course Materials to create your own program, workshop, training or educational product;
record or reproduce Course videos;
remove copyright, trademark or ownership notices; or
represent Course Materials as your own work.
17. Professionals, Schools and Organisations

Unless specifically agreed otherwise in writing, purchase of an individual or family enrolment does not provide a professional, school, clinic or organisational licence.

Teachers, counsellors, psychologists, allied-health professionals, childcare providers, schools and other organisations must not reproduce or use Course Materials with multiple children, clients, families or classes under a family enrolment.

Please contact Calm Kidz Program regarding appropriate professional or organisational permissions where applicable.

18. Intellectual Property and Copyright

All Intellectual Property rights relating to the Course and Course Materials remain the property of Calm Kidz Program or the relevant rights holder.

This includes, where applicable:

written Course content;
videos;
illustrations;
characters;
Emotion Explorer characters and concepts;
worksheets;
workbooks;
activities;
visual resources;
downloadable materials;
branding;
designs;
logos;
photographs;
audio;
teaching frameworks; and
other original Course content.

Purchasing the Course gives you permission to use the Course Materials in accordance with these Terms. It does not transfer ownership of the Intellectual Property to you.

19. Account Security

You are responsible for maintaining the confidentiality of your Course login details.

You must not knowingly allow another family or unauthorised person to use your account.

If you believe your account has been accessed without permission, please contact us.

20. Technology and Course Availability

The Course is delivered using third-party technology and online platforms.

While we take reasonable steps to maintain Course availability, uninterrupted access cannot be guaranteed at all times.

Temporary interruptions may occur because of:

maintenance;
software updates;
internet outages;
third-party platform issues; or
circumstances outside our reasonable control.

We may make reasonable changes to the Course platform, presentation or delivery where necessary.

21. Changes to Course Content

We may periodically update, improve or modify Course Materials to maintain or improve the Course.

This may include updating videos, worksheets, activities, resources or Course presentation.

Such changes will not materially reduce the core service purchased by you during your enrolment.

22. No Guarantee of Outcomes

Every child and family is different.

While the Course is designed to support emotional understanding, regulation skills, parent-child connection and related areas of development, we cannot guarantee any particular result or outcome.

A child's response to the Course may depend on many individual and environmental factors outside our control.

Testimonials, reviews, case examples or descriptions of other families' experiences are illustrative only and do not guarantee that you or your child will experience the same outcome.

23. Limitation of Liability

To the maximum extent permitted by law, Calm Kidz Program is not responsible for indirect, incidental, special or consequential loss arising from your participation in or use of the Course.

Nothing in these Terms is intended to exclude, restrict or modify any liability, consumer guarantee, right or remedy that cannot lawfully be excluded or limited under Australian law.

24. Termination or Suspension of Access

We may suspend or terminate your Course access where:

payments are overdue or unsuccessful;
you materially breach these Terms;
you share Course access or Course Materials without permission;
Course Materials are copied, distributed or used commercially without authorisation;
your use of the Course is unlawful; or
your conduct materially interferes with our services or the rights of others.

Where appropriate, we may provide an opportunity to remedy the issue before permanently terminating access.

Termination or suspension does not remove payment obligations already incurred, subject to applicable law.

If you choose to stop participating in the Course, no change-of-mind refund will be provided and payment-plan obligations remain payable, subject to your rights under applicable law.

25. Privacy and Personal Information

Your privacy is important to us.

Personal information provided when purchasing or participating in the Course will be handled in accordance with our Privacy Policy and applicable Australian privacy laws.

Information may be collected where reasonably necessary to:

process enrolments and payments;
provide Course access;
deliver Welcome Kits and physical resources;
communicate with participants;
provide Course-related email support;
administer the Course; and
comply with legal obligations.

We may use third-party service providers to facilitate services such as Course hosting, payment processing, email communication and delivery.

Please refer to the Calm Kidz Program Privacy Policy for further information about how personal information is collected, used, stored and disclosed.

26. Communications

By enrolling, you consent to receiving communications that are reasonably necessary for delivery and administration of the Course.

These may include:

enrolment confirmation;
Course access information;
weekly Course emails;
reminders;
payment notifications;
important Course updates; and
administrative communications.

Marketing communications will be handled in accordance with applicable law and our Privacy Policy, including applicable unsubscribe options.

27. Third-Party Services

The Course may rely on third-party providers, including Course-hosting platforms, payment processors and email or delivery services.

Your use of some third-party services may also be subject to the provider's own terms and privacy practices.

Calm Kidz Program is not responsible for matters outside our reasonable control arising solely from third-party services, subject to any rights you may have under applicable law.

28. Changes to These Terms

We may update these Terms from time to time to reflect changes to our services, Course delivery, business practices or legal requirements.

The version applying to your purchase will generally be the version made available to you at the time of enrolment, except where a change is required by law or is otherwise permitted under applicable law.

29. Governing Law

These Terms are governed by the laws applicable in Tasmania, Australia, and the parties submit to the jurisdiction of the courts and tribunals of Tasmania and any courts entitled to hear appeals from them.

Nothing in this clause limits any rights you may have under applicable Australian consumer legislation.

30. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be severed or read down to the minimum extent necessary.

The remaining provisions will continue to operate.

31. Entire Agreement

These Terms, together with the relevant Course description, checkout information and Privacy Policy, form the agreement between you and Calm Kidz Program regarding your enrolment.

Any variation must be agreed in writing unless otherwise permitted by these Terms or applicable law.
